Ruth’s Hospitality Group Inc. (“Ruth’s”) offers this guest Wi-Fi Internet Service (the “Service”) to guests according to these Wi-Fi User Terms & Conditions (the “Agreement”). By accessing the Service you agree to be bound by its terms. If you do not agree with these terms, do not use the service. The service is provided at Ruth’s discretion and your access to the Service may be blocked, suspended or terminated at any time for any reason including, but not limited to, violation of this Agreement, violation of applicable laws or regulations, or as we deem necessary to prevent network disruption.
Ruth’s may revise this Agreement at any time. You will be asked to accept this Agreement each time you use the Service and it is your responsibility to review the Agreement for changes each time you access the Service.
Your use of the Service and any activities conducted online through the Service are subject to this policy, and to applicable laws and regulation. You agree that you are responsible for your own use of the Service, and that you will refrain from engaging in any prohibited conduct, including any conduct that is unlawful, infringing (including downloading copyright protected material without the owner’s permission), tortious (including conduct that intentionally or negligently harms others or puts others at risk, such as abusive or harassing communications, or transmitting viruses, trojans or other corrupt software or programs), or any other conduct that a reasonable individual should know would violate another party’s intellectual property rights, privacy right or other rights, or any conduct that interferes with the operation of, use or, or enjoyment of any service, system or other property. You further agree that you will not use the Service for any unlawful, immoral or improper purpose, including the transmission or viewing of any obscene, threatening, hateful abusive or harmful materials.
Ruth’s reserves the right to monitor your communications and activities via the Service during transmission and in connection with your use of the Service, including without limitation information regarding the device you use to access the Service (such as device type and device ID), usage time and volume. By using the Service, you consent to such monitoring.
UNLESS OTHERWISE EXPLICITLY STATED, THE MATERIALS AND THE SERVICE ARE PROVIDED "AS IS." ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID. RUITH’S MAKES NO REPRESENTATIONS, WARRANTIES, CONDITIONS, OR GUARANTIES AS TO THE QUALITY, SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF THE SERVICE OR ANY OF THE MATERIALS PROVIDED WITH THE SERVICE. ANY QUESTIONS REGARDING THE MATERIALS SHOULD BE DIRECTED TO THE PROVIDERS OF SUCH MATERIALS. RUTH’S DOES NOT AUTHORIZE ANYONE TO MAKE A WARRANTY OF ANY KIND ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT. RUTH’S DOES NOT WARRANT THE SERVICES WILL BE UNINTERRUPTED, AVAILABLE, COMPLETE, USEFUL, FUNCTIONAL OR ERROR FREE.
EVEN IF RUTH’S HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RUTH’S WILL NOT BE LIABLE FOR ANY DAMAGES SUFFERED AS A RESULT OF YOUR USE OF THE SERVICE. MOREOVER, IN NO EVENT SHALL RUTH’S BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES SUFFERED AS A RESULT OF YOUR USE OF THE SERVICE (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS, LOST REVENUE, LOST PROFITS, LOSS OF USE, LOSS OF DATA OR OTHER ECONOMIC ADVANTAGE) HOWEVER THEY ARISE, WHETHER FOR BREACH OF CONTRACT OR IN TORT (INCLUDING NEGLIGENCE), OR ANY DAMAGES WHATSOEVER RESULTING FROM INTERRUPTION OR FAILURE OF SERVICE, LOSS DUE TO UNAUTHORIZED ACCESS OR DUE TO VIRUSES OR OTHER HARMFUL COMPONENTS, COST OF REPLACEMENT PRODUCTS AND SERVICES, THE INABILITY TO USE THE SERVICE, THE CONTENT OF ANY DATA TRANSMISSION, COMMUNICATION OR MESSAGE TRANSMITTED TO OR RECEIVED BY YOUR DEVICE, ACCESS TO THE WORLD WIDE WEB, THE INTERCEPTION OR LOSS OF ANY DATA OR TRANSMISSION, OR LOSSES RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR MESSAGES OR DATA RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE.
WHETHER IN COURT, SMALL CLAIMS COURT, OR ARBITRATION, YOU AND WE MAY ONLY BRING CLAIMS AGAINST EACH OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS REPRESENTATIVE OR A CLASS MEMBER IN A CLASS OR REPRESENTATIVE ACTION.
You agree to defend, indemnify and hold harmless Ruth’s Hospitality Group, Inc., its parents, subsidiaries, affiliates, franchisees, and/or assigns together with their respective employees, agents, directors, officers and shareholders, from and against all liabilities, claims, damages and expenses (including reasonable attorney's fees and costs) arising out of your breach of this Agreement or your breach of the copyright, trademark, proprietary or other rights of third parties.
This Agreement will be governed by and construed in accordance with the laws of the state of Florida, without regard to its conflicts of laws provisions. You and Ruth’s expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of the web site shall be in the state or federal courts of the state of Florida, Orange County, and you agree and submit to the exercise of personal jurisdiction of such courts over you for the purpose of litigating any such claim or action.
The failure of Ruth’s to exercise or enforce any right arising from the Terms of Use, a violation of the Terms of Use, or your use of the web site shall not constitute a waiver of such right or provisions. In the event any part of these Terms of Use is found by a court of competent jurisdiction to be invalid or otherwise unenforceable, you and Ruth’s agree that the court should construe that part in a manner consistent with applicable law to reflect as nearly as possible, the original intention of the parties, and the other provisions of the Terms of Use shall remain in full force and effect.
Ruth’s reserves the right, in its sole discretion, to terminate or block your access to the Service, with or without notice.
